1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Trustwell Travel Management ("Trustwell," "we," "us," or "our") governing your access to and use of www.trustwelltravel.com (the "Site") and any services, information, or content offered through the Site.


2. Eligibility

You must be at least 18 years of age to use this Site. By using this Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding agreements in your jurisdiction.


3. Travel Services — Nature of Our Role

Trustwell Travel Management is an independent travel consultancy and management company affiliated with Global Travel Collection (GTC). We act as an agent on your behalf in arranging travel services provided by third-party suppliers including, but not limited to, cruise lines, hotels, airlines, tour operators, and ground transportation providers.

Important: Trustwell is not the provider of travel services themselves. We facilitate bookings and provide consulting expertise. All travel services are subject to the terms, conditions, and limitations of the respective suppliers.


4. Bookings, Payments & Cancellations

4.1 Booking Agreement

A binding booking is formed only when: (a) you have received written confirmation from Trustwell, and (b) applicable deposits or payments have been received and confirmed by the relevant supplier.

4.2 Payment Terms

Payment terms, deposit schedules, and final payment deadlines will be specified in your voyage proposal or booking confirmation. Trustwell accepts payment via [accepted methods]. All prices are quoted in USD unless otherwise stated and are subject to change until booking is confirmed.

4.3 Cancellations & Refunds

Cancellation policies vary by supplier, voyage, and fare class. Penalties may apply and can be substantial, including forfeiture of full payment. We strongly recommend the purchase of comprehensive travel protection insurance. Trustwell's service fees, once earned, are non-refundable.

4.4 Travel Protection Insurance

While travel insurance is not mandatory, Trustwell strongly recommends that all clients purchase comprehensive travel protection, including trip cancellation, medical, and evacuation coverage. We can assist in identifying suitable options.


5. Accuracy of Travel Information

While we make every effort to ensure that information on our Site and in our proposals is accurate and current, travel prices, availability, itineraries, and supplier terms are subject to change without notice. Trustwell is not responsible for errors or omissions in third-party information, typographical errors, or changes made by suppliers after booking confirmation.


6. Limitation of Liability

6.1 Third-Party Supplier Liability

Trustwell acts solely as an agent for third-party travel suppliers. We are not liable for the acts, errors, omissions, representations, warranties, or negligence of any travel supplier, or for any personal injury, death, property damage, or other damages arising from supplier services.

6.2 Cap on Liability

To the maximum extent permitted by applicable law, Trustwell's total liability to you for any claims arising from your use of the Site or our services shall not exceed the lesser of: (a) the total fees paid by you to Trustwell in the 12 months preceding the claim, or (b) $5,000 USD.

6.3 Exclusion of Consequential Damages

IN NO EVENT SHALL TRUSTWELL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, GOODWILL, OR SERVICE INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.4 Force Majeure

Trustwell is not liable for failure to perform or delay caused by circumstances beyond our reasonable control, including natural disasters, pandemics, acts of terrorism, governmental actions, labor disputes, or technical failures.


7. Intellectual Property

All content on this Site — including text, images, logos, graphics, voyage descriptions, and brand elements — is the proprietary property of Trustwell Travel Management or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.

You may not:

  • Copy, reproduce, modify, or distribute Site content without express written permission

  • Use Trustwell's name, logo, or brand materials for commercial purposes

  • Scrape, data mine, or use automated tools to extract Site content

  • Represent that any content is affiliated with or endorsed by Trustwell without authorization


8. User Conduct

You agree not to use this Site to:

  • Violate any applicable law or regulation

  • Transmit fraudulent, misleading, or harmful content

  • Impersonate Trustwell, GTC, or any other person or entity

  • Interfere with Site security, servers, or networks

  • Introduce malware, viruses, or other harmful code

  • Collect or store personal data of other users without consent

  • Engage in any conduct that damages Trustwell's reputation or the trust of our clients


9. Testimonials & User-Submitted Content

If you submit a testimonial, review, or any other content to Trustwell, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in our marketing materials and Site. You represent that you have the right to make such submissions and that the content does not infringe any third-party rights.


10. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRUSTWELL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.


11. Indemnification

You agree to indemnify, defend, and hold harmless Trustwell, its officers, directors, employees, agents, affiliates (including GTC), and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any booking or travel services arranged on your behalf.


12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

12.2 Mandatory Arbitration

Any dispute, claim, or controversy arising from these Terms or your use of the Site shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive the right to participate in class action lawsuits or class-wide arbitration.

12.3 Exceptions

Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm. Small claims court matters also remain available as applicable.

12.4 For EU/UK Users

Notwithstanding the foregoing, if you are an EEA or UK consumer, you retain the right to bring claims in the courts of your country of domicile and may use the EU Online Dispute Resolution platform at ec.europa.eu/odr.


13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via Site notice. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
